Deltona man arrested, accused of ‘mercilessly beating’ dog at gas station


A Deltona man was arrested Thursday after police said he beat a dog outside a gas station.

According to a Facebook post by Volusia Sheriff Mike Chitwood, bystanders saw Jose Rivera, 31, “mercilessly beating his dog” and intervened before calling 911.

In a video shared by the sheriff’s office, a man is seen stepping between Rivera and the dog in front of the gas station; the dog then runs away toward other witnesses. The video then shows witnesses physically restraining Rivera in a struggle.

Rivera is charged with felony animal cruelty, resisting an officer, child abuse, and three counts of battery, “stemming from his attacks on those witnesses,” Chitwood wrote in the Facebook post.

“The dog is doing OK and was turned over to Deltona Animal Control, which placed the dog in a home where Rivera does NOT live,” he added.

Rivera was taken to the Volusia County Jail, where he made his first court appearance Friday afternoon. He is being held on $26,000 bond.

If convicted of the animal cruelty charge, Rivera would face five years in prison and a $5,000 fine.
